Who is legally required to implement the Accessibility Strengthening Act (BFSG)?
The BFSG affects almost all B2C businesses offering products or services in electronic commerce. This includes online shops, ticket portals, booking platforms, and websites where contracts can be concluded. Micro-enterprises (fewer than 10 employees and max. €2M annual revenue) are exempt for services, but the obligation still applies to products.
What fines or penalties apply for non-compliance?
Market surveillance authorities can impose fines of up to €100,000 or, in severe cases, order the shutdown of the non-compliant website. Furthermore, businesses face expensive competitor cease-and-desist warnings under competition law.
What is the difference between WCAG, BITV, and BFSG?
The WCAG (Web Content Accessibility Guidelines) are the international technical standard. BITV is the German accessibility regulation for public bodies. The BFSG is the law that translates the European Accessibility Act (EAA) into German national law for the private sector. Technically, they all reference WCAG 2.1 AA.
Will accessibility optimization ruin my website design?
